Limited Assistance Representation in Divorce and Family Law Matters
Some people find that — although they can afford to pay for some legal assistance — the cost of full-service representation is prohibitive. Still others desire to retain more control over their cases and turn to an attorney to coach them or assist with completing their paperwork, preferring to retain primary control over their legal matters and appear in court themselves. In some cases only one issue, such as child custody or division of pension benefits, is quite complex and technical, while some others are relatively straightforward. In those cases, the attorney may assist the client and perhaps even appear in court on the more difficult aspects. The attorney may also coach the client and explain the court's procedures before they go to court on their own on the simpler issues. Limited assistance representation (LAR) allows you to hire an attorney to help you with only those parts of your case where you need legal help and advice. In addition to saving money, this also gives clients the control they want throughout the divorce.
LAR encompasses a range of attorney-client relationships where the attorney handles part, but not all, of a legal matter. It can include everything from rendering advice and counsel referred to as "coaching," to assistance with drafting of court documents, referred to as "ghostwriting," to situations where the attorney actually appears in court on a limited basis for part of a legal proceeding. Each limited assistance arrangement is different, and is tailored to meet the client's needs depending on the complexity of the legal and factual issues presented, the client's ability to self-represent, and the professional judgment of the attorney regarding which parts of a case may be effectively segregated and reassigned.
